Slip and Fall Injuries - Fall in a Store Accident

Slip and Fall in a Store Accident NJ
Did you sustain slip and fall injuries? Everybody needs to run errands. We try to do things efficiently so we can spend the rest of our time enjoying ourselves. Except, sometimes, you go into a store to run an errand and end up falling because the store failed to keep the isles clean. Maybe you slipped on food. Maybe you slipped on a liquid substance on the floor. Many questions arise. Did the store know about this? Why didn't they clean it up? How long was it on the floor? Did anyone else fall? We take the time to investigate these questions because the answers are very important to your case.

The Rubinstein Law Firm, LLC New Jersey slip and fall accident attorneys help individuals and their families who have been injured in all types of fall down accidents.

Common types of falls in stores

  • slip on food at concession stand
  • slip on liquid in aisle
  • slip on rain water in store
  • slip on leak from ceiling
  • slip on snow dragged in from outside
  • slip on detergent in aisle
  • slip on grapes or fruit in fruit aisle

Elements that must be proven

To establish a case of negligence when you fall in a store, you must prove:
  1. the owner had a duty to keep the area free from hazards
  2. the owner breached that duty and did not keep the area safe
  3. the substance on the floor caused you to fall
  4. you sustained injuries because of falling

Proving the store knew about the dirty floor

A business owner has a duty of reasonable care owed to its "invitees" to provide a safe environment. The duty of care requires a business owner to discover and eliminate dangerous conditions on the property and keep it safe. Just because you fell does not mean that the business owner did something wrong. In every fall down case, the plaintiff must prove that either (a) the store knew there was something dangerous on the floor and did nothing about it (called actual notice), or (b) did not know but should have known (called constructive notice). Slip and fall cases can be difficult, however, we have been very successful in assisting our clients with a recovery for their pain and suffering.
